It is submitted that the matter got mentioned and the Appeal was dismissed as withdrawn. He was present in the High Court and therefore, his appearance may be marked in the Order dated 09.01.2026. 3.

Once the matter got withdrawn on mentioning, there was nothing to be done by learned counsel for Respondent No.1. 4.

Admittedly, he had not appeared and therefore, there is no ground for marking his appearance in the Order dated 09.01.2026. 5.

Application is dismissed.
