O R D E R

The present petition has been filed by the petitioner assailing an order dated 26.05.2022, whereby the contract dated 20.08.2021 between the parties has been terminated. By the said contract dated 20.08.2021, the petitioner was engaged for providing manpower supply to the respondent/department.

It is the case of the petitioner in the present petition that the termination was unjustified and arbitrary. In the counter-affidavit filed on behalf of the respondents, the allegations made by the petitioner have sought to be refuted. It has been specifically stated as under:- "6.

That the contents of Paragraph 6 are false and hence vehemently denied. It is submitted that the Contract between Petitioner and Respondent is governed by the Central Terms and Conditions of the Contract and Clause 16 of the Contract provides for Amicable settlement of disputes through either settlement or Arbitration as per Clause 16.2. Therefore, an efficacious and alternative remedy has been provided to the Petitioner and hence this petitioner is premature and not maintainable."

After some hearing, learned counsel for the petitioner accedes that the grievance of the petitioner can be agitated by taking recourse to the dispute resolution mechanism prescribed under the said contract. 4.

Accordingly, he seeks leave to withdraw the present petition with liberty to avail appropriate remedy under the prescribed dispute resolution mechanism.

The present petition stands disposed of with liberty as prayed for. 6.

Needless to say, if the concerned respondent seeks to canvas any claim against the petitioner, it shall also take recourse to the applicable dispute resolution mechanism.
