The petitioners in the present petition are aggrieved by the noncompletion of the formalities of the registration of the sale deed qua the property bearing no.E-122A, First Floor, Greater Kailash-II, New Delhi110048. 2.

Vide order dated 16.05.2025, this Court recorded as follows: "6. The ostensible basis for the same is that the property was attached by the Enforcement Directorate in Special Case No.09.2021 arising out of CM's SVC P.S. No. 09/2017 pending in the Court of Special Judge, Assam. However, learned senior counsel for the petitioner points out that the attachment order of the Enforcement Directorate was set aside in Case No.Crl. Pet./858/2023 vide order dated 13.03.2025 by the High Court of Assam. As such, there is no impediment in delivering the registered sale deed to the petitioner.

Learned counsel for the respondent nos.1 and 2, who appears on advance notice, submits that the concerned Sub-Registrar has already written to the Enforcement Directorate seeking a confirmation as to the aforesaid facts. It is submitted that as soon as the confirmation is received from the Enforcement Directorate that no attachment subsists in respect of the property in question, a copy of the Registered Sale Deed shall be supplied to the petitioner.

8. Learned counsel for the Enforcement Directorate seeks some time to take instructions.

9. The Enforcement Directorate is directed to expeditiously respond to the communication of the Sub-Registrar as referred to hereinabove." 3.

Today, learned counsel for the Directorate of Enforcement / respondent no. 4 informs that there is no subsisting attachment order qua the property in question.

As such, there is no impediment in completion of the formalities for registration of the sale deed qua the said property purchased by the petitioner.

In the aforesaid circumstances, the concerned Sub-Registrar / respondent no. 2 is directed to proceed with the registration of the sale deed subject to applicable rules and guidelines. Let the registered sale deed be handed over to the petitioners as per the applicable procedure. 6.

Let the same be done expeditiously and preferably within a period of three weeks from today.
