After some arguments, Mr. Khatri, learned counsel appearing for the appellant submits that he has no objection to the impugned order, however, has expressed his reservation to the admission recorded on page no.2 of the impugned order, wherein it has been recorded that it is admitted that the property in Khasra No.329 is a joint property and that other properties mentioned at para. no. (ii) to (vi) are also joint properties. 2.

In view of the above, the present appeal is disposed of alongwith the pending application.

Needless to state, the aforesaid observations are only prima facie and the appellant shall be at liberty to raise all contentions before the Trial Court at the appropriate stage, and nothing contained in the impugned order shall be binding on the parties during trial.
