The present application has been filed for grant of regular bail under Section 439 Cr.P.C. r/w Section 482 Cr.P.C. in case FIR No. 100/2024 registered under Section 308/34 IPC at PS Sunlight Colony. 2.
The petitioner was granted interim bail vide order dated 21.01.2024 on the ground of illness of the mother of the petitioner. 3.
The FIR was lodged on the basis of a DD entry. On reaching the spot, IO came to know that that the injured person is admitted in the hospital. The statement of injured Bahare Khan was recorded. 4.
As per the status report filed by the prosecution, there were two injured namely Adnan and Bahare Khan. Injured Adnan had suffered grievous injuries and injured Bahare Khan suffered simple injuries. 5.

petitioner along with Abhishek had caused injuries. 6.
As per the status report, Bahare Khan stated that on 29.03.2024 when the passengers were getting off from his auto, one person driving a chhota Hathi vehicle blew horn and told him to remove his auto. It has further been alleged that the driver came and started beating the injured, Bahare Khan, with fists and blows while another person attacked him with fire extinguisher. Injured Bahare Khan contacted Adnan and told him to come on spot. Adnan also came on the spot and was allegedly, attacked by Abhishek with the same fire extinguisher. It is further alleged that the petitioner hit injured Adnan with Danda due to which he was injured on his head. The fire extinguisher was seized however the danda could not be found.

I have heard the submissions.

Perusual of the record indicates that the petitioner is in custody since 30.03.2024 and the investigation is already complete with the chargesheet also filed. The petitioner also has no criminal antecedents, and it has been submitted that the injured has also been discharged. 9.
In view of the facts and circumstances, the petitioner is admitted to regular bail on furnishing a personal bond of Rs. 20,000/- with one like amount surety subject to the satisfaction of the concerned court/MM/CMM/Duty MM with the following conditions: a) the Petitioner shall cooperate in the investigation and appear before the Investigating Officer of the case as and when required; b) the Petitioner shall under no circumstances leave India without prior permission of the Court concerned;

c) the Petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case; d) the Petitioner shall provide his residential address and mobile number(s) to the Investigating Officer and keep it operational at all times;
e) In case of change of residential address and/or mobile number, the Petitioner shall intimate the same to the Investigating Officer/ Court concerned by way of an affidavit
