O R D E R

The present writ petition has been filed, inter alia, seeking directions to the respondent no. 2 to install the electricity connection in the property of the petitioner situated at A-368A, comprised in Khasra No. 262 Min, Chhattarpur Enclave, Phase-2, New Delhi-110074. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

When the matter was listed for hearing on 7th May, 2024, this Court had directed that a joint inspection be carried out by the respondents and the petitioners, in order to ascertain whether the property bearing no. A-368A, is a separate property from the property bearing no. A-362A, which stands booked by the Municipal Corporation of Delhi ("MCD") for unauthorised construction, as per letter dated 6th March, 2024 of the BSES Rajdhani Limited.

Pursuant thereto, a Status Report has been filed on behalf of the MCD, which reads as under:

Perusal of the aforesaid Status Report filed on behalf of MCD, shows that it is the clear stand of the MCD that the property no. A-368A, Chhattarpur Enclave, Phase-2, New Delhi-110074, which is subject matter of the present writ petition, is completely different from the property which is stated to have been booked by the MCD, as per letter dated 06th March, 2024 of the BSES Rajdhani Limited.

Therefore, it is evident that the property of the petitioner is not subject matter of any unauthorised construction or booking by the MCD. Thus, there is no impediment in granting electricity connection to the premises of the petitioner at A-368A, Comprised in Khasra No. 262 Min, Chhattarpur Enclave, Phase-2, New Delhi-110074.

Accordingly, the petitioner is directed to apply for a fresh electricity connection with the respondent no. 2. Upon the application being filed by the petitioner, the BSES Rajdhani, shall process the application of the petitioner, expeditiously and thereby grant a fresh electricity connection to the petitioner, subject to compliance with all codal and commercial formalities for grant of a new electricity connection. At this stage, learned counsel appearing for the respondent no. 2, submits that in view of the construction in the locality, it is difficult to locate the said property.

Accordingly, considering the aforesaid submission made by learned counsel appearing for respondent no. 2, it is directed that the phone number of the petitioner/his representative along with his counsel, shall be given, which shall be duly reflected in today's order. 9.

It is further directed that as and when the BSES Rajdhani connects with the petitioner on his phone number, the petitioner shall cooperate with BSES Rajdhani for the purposes of location, and installation of a new electricity meter.
