Petitioner herein had filed a suit which was dismissed. 2.

However, while dismissing the suit, learned Trial Court had also awarded cost to the defendant and armed with such order, the concerned defendant had filed an Execution Petition which was registered as Ex. (Comm) 357/2024. 3.

The plaintiff filed objection in such Execution Petition and his sole grievance was with respect to the fact that since the amount claimed in the execution was lesser than the pecuniary jurisdiction of the Court, it should not have been entertained and was not maintainable.

Learned counsel for the petitioner, however, submits that thereafter there is significant development as the learned Trial Court has already issued transfer certificate on 30.05.2025 and, therefore, as per the instructions, the petitioner is no longer interested in pursuing with present petition. 5.

In view of the above, the petition is dismissed as withdrawn. 6.
