These two petitions have been filed under Section 11 of the Arbitration and Conciliation Act, 1996 for appointment an Arbitrator. 2.

Despite opportunity, no reply is forthcoming. Accordingly, this Court is of the view that an Arbitrator needs to be appointed. Accordingly, this Court appoints Justice Manmohan Singh a retired Judge of this Court as a Sole Arbitrator for adjudicating the disputes and difference between the parties in these two petitions. The appointment of the Sole Arbitrator shall be regulated by the Rules of the DIAC.

Let a copy of this order be sent to Justice Manmohan Singh for information. Liberty is also with the learned counsel for the parties to appear before Justice Manmohan Singh after taking a prior appointment on his Mobile No: 9717495001.

It is made clear that the parties are within their rights to take all pleas available to them both on facts and in law.
