By the present petition, the petitioner seeks following prayers :
(a) Direct the Respondent no.1 (SHO P.S. Nabi Karim) to take immediate action against miscreants who cause obstruction and interference in the affairs of petitioner society and take appropriate action against any person who tries to disturb the peace of society.

(b) Direct Respondent no.2 to not to interfere or cause any obstruction in the management and affairs of petitioner/society and not to disturb the peaceful possession of the Dargah with the Petitioner.
(c) Grant any further relief, which this Hon'ble Court may deem fit and proper in the facts and circumstances of the present case and in the interest of justice.

The petitioner appears to be managing some society and alleges that obstruction is being caused by Respondent No. 2 in the affairs of the said society. Prayer in the nature of direction to not cause obstruction cannot be granted while exercising writ jurisdiction.

Such relief even otherwise in the opinion of this Court, is in the nature of a civil dispute which ought to be adjudicated in appropriate proceedings.

In regard to the Prayer (b) to the extent that the directions are sought for non-disturbance of peaceful possession, undisputedly, a suit in that regard is already pending before the learned Civil Court.

In view of the above, no orders can be passed in the present petition and the petition is disposed of. 6.
Needless to state that in case any complaint is filed by the petitioner at any stage before police, the Police is duty bound to take appropriate action in accordance with law. AMIT MAHAJAN, J AUGUST 19, 2025 'KDK'
