None appears for the respondents despite service of notice. 2.

The petitioner has filed the present petition, inter alia, praying that Civil Suit No.17865/2016 captioned 'Ishwari Devi v. Sunita Gulati & Ors.' be transferred from the court of learned ADJ-10 (Central), Tis Hazari Courts to the District Judge, (North District), Rohini Court, Delhi. The petitioner states that the said suit was initially filed before this Court and numbered as CS(OS) No.1496/2012. The said suit was transferred to the District Court, Central by an order dated 02.02.2016 in view of the enhancement of the pecuniary jurisdiction of the courts.

He submits that the said order was erroneous as the suit property - A1/9, Rana Pratap Bagh, New Delhi - was located within the territorial jurisdiction for the District Court, North District, Rohini Court Complex.

In view of the above, the present petition is allowed and the said suit - Civil Suit No.17865/2016 captioned 'Ishwari Devi v. Sunita Gulati & Ors.'

- is transferred to the District Court (North District), Rohini Court. 4.

The parties are directed to appear before the concerned court on 19.08.2019.
