The Court is of the prima facie opinion that the request made in the instant petition can be reiterated in Test Cas No.8/2024 and the said Court would be in a better position to appreciate the facts and circumstances being already seized with the controversy.

Learned counsel appearing on behalf of the petitioner, therefore, seeks liberty to withdraw the instant petition with further liberty to approach the Court before which Test Cas 8/2024 is currently pending to seek transfer of case bearing PC No.2/2024, which is pending before the Court of ADJ-01, East District, Karkardooma Courts, Delhi.

With the aforesaid liberty, the instant petition stands dismissed as withdrawn.
