By way of the instant petition, the petitioners seek quashing of FIR bearing no. 0550/2019, registered at Police Station New Ashok Nagar, Delhi for the commission of offence punishable under Sections 308/427/34 of the Indian Penal Code, 1860 (hereafter 'IPC').

Briefly stated, facts of the present case are that on 12.11.2019, a quarrel took place between the petitioners and respondent no. 2 on the issue of parking, in which both the parties had sustained injuries. Thereafter, respondent no. 2 had lodged a complaint against the petitioners before the concerned police station culminated into the present FIR. It is stated that on the same date, a cross FIR bearing No. 0549/2019 was also got registered against the respondent no. 2 and his brother, for the commission of offence punishable under Sections 323/341/506/34 of IPC. 7.

It is stated that both the parties have amicably settled their dispute vide Settlement Deed/Memorandum of Understanding dated 12.11.2024, entered into between them.

On a query made by this Court, respondent no. 2 who has been identified by the concerned IO, has categorically stated that he has entered into compromise out of his own free will and without any pressure, coercion or threat. It is also stated by respondent no. 2 that the entire dispute has been amicably settled between them. Respondent no. 2 further states that he has no objection, if the present FIR is quashed.

In view of the above fact that the parties have amicably resolved their differences out of their own free will, without any coercion and no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 10.

New Ashok Nagar, Delhi for the commission of offence punishable under Sections 308/427/34 of IPC and all consequential proceedings emanating therefrom are quashed, subject to the petitioners depositing cost of Rs.5,000/- each with the Advocates Welfare Fund, Karkardooma Courts, Delhi within seven days from date.
