% 24.09.2019 The present petition has been filed by the petitioner under Section 11

(6) of the Arbitration and Conciliation Act, 1996 for appointment of an Arbitrator.

Learned counsel for the petitioner has drawn my attention to the work order dated February 23, 2017, clause 30 thereof is relatable to settlement of dispute through arbitration. Learned counsel for the petitioner states, in terms of clause 30, the proceedings shall be held in the NCR of India at a location as per the choice of Arbitrator.

There is no appearance for the respondent. The arbitration clause was invoked by the petitioner vide letter dated May 16, 2019. It is stated that no reply to the notice invoking arbitration clause was received by the petitioner. The disputes having arisen, this court is of the view that an Arbitrator needs to be appointed. Accordingly, the parties are relegated for arbitration process under the aegis of the Delhi International Arbitration Centre, who

shall appoint an Arbitrator from their panel. The appointment of the Arbitrator shall be regulated by the Rules of DIAC. The parties shall appear before the Coordinator, DIAC on October 09, 2019. A copy of this order be sent to the Coordinator, DIAC. The petition stands disposed.
