O R D E R

% 14.01.2016 Learned counsel for the parties state that the suit was primarily directed against the defendant No. 1. They also state that the defendant Nos. 2 to 4 were the tenants in the property. They further state, in a different suit i.e. CS (OS) 1799/2012 titled 'Manjeet Mongia and Anr. Vs. Gurmeet Singh Chopra and Anr.', which was also a litigation between the plaintiff and the defendant No. 1 and the other family members, which mater had gone to the mediation, wherein they have settled their disputes in terms of the settlement agreement dated October 16, 2015. They also state, one of the terms of the settlement was, the plaintiff herein i.e. Gurmeet Singh Chopra (defendant No. 1 in Civil Suit No. 1799/2012), would unconditionally withdraw the

present suit i.e. CS (OS) 780/2014.

In view of the aforesaid position, Mr. Manmeet Singh, Adv. appearing for the plaintiff, seeks to withdraw the present suit. The suit is accordingly dismissed as withdrawn. The copy of the settlement agreement dated October 16, 2015 as submitted by the counsel for the defendant No. 1, is placed on record.
