This joint application is filed on behalf of the parties to the lis under Order XXIII Rule 3 CPC for recording of settlement. 2.

During the pendency of the suit, parties have settled the matter and resolved all their inter se disputes. Settlement Deed dated 03.01.2026 has been executed incorporating the terms of settlement, which is placed on record.

Court has perused the terms of settlement and finds the same to be lawful. Accordingly, this application is allowed recording the settlement between the parties and taking the Agreement on record. 4.

Application stands disposed of.

restraining the Defendants from infringing the trademark JAIN SAREE HOUSE (logo and word mark), passing off, unfair competition, dilution, delivery up, damages and rendition of accounts, etc. 6.

The suit is decreed in terms of the Settlement Agreement dated 03.01.2026 and the same shall form a part of the decree as Exhibit A-1. Needless to state that the terms of settlement shall bind the parties. 7.

Registry is directed to draw up the decree sheet. 8.

The suit is disposed of along with pending application. 9.

Plaintiff is held entitled to refund of the entire court fees under the provisions of Court Fees Act, 1870.

Date of 13.03.2026 stands cancelled.
