Petition under Section 482 Cr.P.C. has been filed seeking quashing of FIR No. 0939/2018 dated 06.11.2018 under Sections 279/337 IPC registered at PS: Bindapur on the basis of settlement dated 20.11.2020 between the Petitioner and Respondent No.2 Poonam / complainant. 2.
It is submitted that the chargesheet has been filed under Sections 279/337 IPC and Sections 3/181 and 5/181 of Motor Vehicles Act, 1988. The Detailed Accident Report (DAR) was also filed in respect of FIR No.0939/2018, in which Rs.5,000/- have already been paid to the injured. Pursuant to the settlement dated 20.11.2020, additional sum of Rs.10,000/- has been paid, though it does not found mention in the settlement deed. 3.
It is further submitted that though the accident occurred, but no visible injury was suffered by Respondent No.2, as per MLC and despite having entered into the settlement, Respondent No.2 is not forthcoming for The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Considering that the present Petition has been duly supported by affidavit of Respondent No.2, the settlement deed dated 2011.2020, which bears her signatures and also considering that matter has already been settled in Detailed Accident Report proceedings under Motor Vehicles Act, 1988 and that the complainant despite service refused to appear, no fruitful purpose would be served in continuing with the FIR No. 0939/2018 under Sections 279/337 IPC, which is hereby quashed along with all the proceedings emanating therefrom.

However, insofar as the offence under Sections 279/337 IPC and Sections 3/181 and 5/181 of Motor Vehicles Act, 1988 is concerned, Petitioner is directed to deposit the find amount of Rs.1,000/- before the learned Trial Court within seven days.
