% 10.08.2018 IA No. 5422/2018 This application is under Section 151 CPC for payment of additional fee to the Local Commissioner as he has conducted the proceedings since the year 2010.

Admittedly Rs.1,50,000/- has been paid to him but since the proceedings have taking such a long period hence it would be appropriate to compensate the Local Commissioner and further fee should be paid to him.

In the circumstances the Local Commissioner be paid Rs.25,000/- by both the parties jointly. It is submitted by the learned counsel for the plaintiff that they had already paid their half share and hence the half amount be paid by the defendant. The application stands disposed of accordingly.

Evidence is complete. The matter is to be listed for final arguments. Since both the counsels submitted the value of the suit property was Rs.22,00,000/- at the time of the filing of this suit as alleged in para 46 of the plaint and since the value of the suit property is less than Rs.2 crores the matter be sent to the concerned District Judge. Ordered accordingly.

Let the parties to appear before the learned District Judge (HQ) on 10.09.2018.
