% 17.04.2017 The three petitioners in this petition are workmen/ employees of respondent-Management, who were charge-sheeted way back in the year 1999 and were placed under suspension on the charge of misappropriation of credit of huge amounts. By the concerned authority, the following reference was made to the trial court:- "Whether continuance of suspension of Sh.

M.S. Marwah, Sh. S.S. Walia, Sh. Yatender Kumar and Sh. Pardeep Kumar, is illegal and / or unjustified and if so, to what relief are they entitled and what directions are necessary in this respect?" The aforesaid reference has been answered in the negative vide impugned Award of 21st May, 2003.

When this petition was taken up for regular hearing, none had appeared on behalf of petitioners and vide order of 15th September, 2015, Court Notices were issued to petitioners and their counsel. Court notice sent to petitioners' counsel was received back as per order of 16th November, 2015 but none had appeared on behalf of petitioners. As per order of 9th December, 2015, Court Notices sent to first petitioner was received back with the report that he is no longer interested in pursuing this petition. It is noted in the order of 9th December, 2015 that it appears that petitioners are not interested in pursuing this petition. However, no adverse orders were passed. On the last few dates of hearing, none has appeared on behalf of petitioners.

In view of aforesaid, this petition and applications are dismissed in default and for non-prosecution.
