Mr. Nishant Gautam, learned Central Govt. Standing Counsel (CGSC) on instructions submits that there is no power to review the impugned decision dated 19.04.2024. It is, however, submitted that the petitioner company is at liberty to re-submit e-form NDH-4 for registration of the company in terms of Section 46 of the Companies Act.

Learned counsel for the petitioner has no objection. 3.

The present petition is disposed with the direction that the petitioner company shall be at liberty to re-submit e-form NDH-4 for registration of the company and the same shall be decided in accordance with law. However, the respondent shall not be prejudiced by any findings recorded in the previous order dated 29.04.2024, and shall consider the merits on its own afresh.
