An Application has been filed on behalf of the Appellants on the ground that the matter has been amicably settled between the Appellants as well as Respondent No.1 to 3 and it is submitted that Rs.13 lakhs have been paid to Respondent No.1 to 3 who are present in the Court today and endorse that they have received Rs.13 lakhs and that all their claims under the Judgment stands satisfied.

The Respondent No.4 BSES is the formal party. Respondent No.5 was the brother of Appellant No.1 who was a proforma party, since he did not join the Appellant in instituting the litigation. 3.

In view of the Settlement inter-se the parties, the Appeal is disposed of without prejudice to the rights of the Respondent No.4 and 5, if any, since they are not a party to the Settlement.
