This is a petition seeking appointment of a Presiding Arbitrator to adjudicate the disputes between the parties arising out of Agreement dated 09.01.2021.

The arbitration clause is Clause 12 of the Agreement. 3.

The petitioner invoked arbitration vide Legal Notice dated 27.07.2023.

Mr. Mehta, learned counsel for the petitioner states that they already appointed their Nominee Arbitrator.

Mr. Avi Leuna, learned counsel appears for the respondent and states that the respondent had also appointed their Nominee Arbitrator. However, their Nominee Arbitrator has withdrawn his consent and they will appoint a new arbitrator within two weeks from today.

For the said reasons, Mr. Justice Vipin Sanghi (Retd.) (Mob: 9871300037) is appointed as a Presiding Arbitrator to adjudicate the disputes.

The fee of the Arbitrator will be as per the Fourth Schedule of the Arbitration and Conciliation Act, 1996.

The petition is accordingly disposed of.
