Learned counsel for the plaintiff seeks permission to withdraw the present suit as the matter has been settled before the Delhi High Court Mediation & Conciliation Centre vide settlement agreement dated 03.11.2017.

It is further informed that the terms and conditions incorporated in the settlement deed have since been complied with. 3.

Learned counsel for the defendants has no objection to the withdrawal of the present suit by the plaintiff. 4.

In view of this, the suit is dismissed as withdrawn. 5.

Since the matter has been settled before the Delhi High Court Mediation & Conciliation Centre, the plaintiff is entitled for the refund of the court fee under Section 16 of the Court fee Act.
