% 07.01.2019 After hearing some arguments learned counsel for the petitioner says that he shall not challenge the impugned order on merits if the petitioner is allowed to stay in the premises for further six months. Learned counsel for the respondent submits that if he intends to stay in the premises the petitioner must pay the user charges as per market rate. Since the present market rental as alleged by the respondent is disputed by the petitioner so as an interim measure let the petitioner pay Rs.7,500/- per month from today on or before 7th of each month till the premises is vacated on or before 06.07.2019 besides the water and electricity charges payable as per actual. The petitioner shall vacate the premises on or before 06.07.2019 positively. Undertaking to this effect shall be filed by the petitioner within two weeks from today.
It is made clear if this condition is violated the respondent shall have a right to execute the eviction order forthwith.
