The present application under Section 151 of the CPC seeks the following prayers: - "Therefore, in the light of above-mentioned facts and circumstances, it is most respectfully prayed that this Hon'ble Court be pleased to: Allow the present application as preferred by the Petitioner, thereby allow the Petitioner to withdraw the captioned matter with liberty to file afresh as such withdrawal by the petitioner being without prejudice to his rights and contentions in any present or future proceedings between the captioned parties due to the reason mentioned hereinabove;

AND/OR Pass any Such other and further orders and/or directions as this Hon'ble Court may deem fit and proper in the interest of justice." 3.

respondent had instituted proceedings under Section 125 of the CrPC in violation of the covenants and clauses of deed of Mubaraat dated 15.11.2022. It is pointed out that the said proceedings have since been dismissed in default for non-prosecution.

In view of the above, he seeks leave to withdraw the present petition with liberty to revive the same in case of any further breach. 5.

The present application is allowed and disposed of. CONT.CAS(C) 797/2024 6.

In view of the above, the present petition is dismissed as withdrawn and disposed of with liberty to the petitioner to revive the same in case of any further non-compliance.
