By way of the present appeal, the appellant seeks to assail the judgement of conviction dated 02.03.2023 and order on sentence dated 20.03.2023 passed in SC No. 2405/2016 arising out of FIR No. 443/2015 registered at P.S. Lajpat Nagar vide which he was directed to undergo rigorous imprisonment for a period of 10 years, for the offences punishable under Sections 21(c)/61 NDPS.

27.05.2025 under the signature of Superintendent of Prison, Central Jail No. 8/9, Tihar, New Delhi is on record. As per the said report, the appellant, having completed his entire sentence of 10 years, was thereafter handed over to the police officials of P.S. Lajpat Nagar for further transfer to the Foreign Regional Registration Office (F.R.R.O.), for deportation to his native country, i.e., Afghanistan.

Learned APP for the State submits, on instructions, that the appellant has since been deported.

Learned counsel for the appellant submits that the appellant had preferred an application bearing CRL.M.A. No. 26135/2023, vide which he had pleaded guilty, prayed to be released on the period already undergone by him, and stated that he did not wish to press the present appeal on merits. In pursuance of directions passed by the predecessor Bench, the appellant had appeared through VC and, during interaction, reiterated his prayer to be released on the period already undergone by him. However, the present appeal and the said application remain pending. The issues noted in the earlier order are left open to be considered in appropriate case. 5.

Considering that the appellant stands released on completion of sentence and has already pled guilty, the present appeal has become infructuous and is disposed of as not pressed, along with pending applications.
