W.P.(C) 7251/2019 & CRL.M.(BAIL) 1179/2019 Issue notice. Learned counsels for respondents accept notice. He points that the petitioner has not availed of the remedy available to him under Section 117(2) of the BSF Act, 1968. On the same being pointed out, learned counsel for the petitioner submits that the present petition itself be considered by the DG, BSF as a post confirmation petition under Section 117(2) of the BSF Act, 1968. The respondents have also agreed to do so.

Accordingly, this petition is disposed of with a direction to the DG, BSF to consider the present writ petition as the petitioner‟s post confirmation petition under Section 117(2) of the BSF Act, 1968 and to decide the same within six weeks.
