By way of present petition filed under Section 397 Cr.P.C., the petitioner seeks to assail the order dated 31.01.2024 passed by Ld. ASJ (FTSC), South West District, Dwarka, Delhi whereby order dated 20.01.2023 passed by Ld. M.M., (Mahila Court) in Complaint Case No. 1643/2022 has been upheld.

Vide the impugned order dated 20.01.2023, Ld. M.M. granted the ad interim maintenance to the respondent. The said order was carried in appeal before the Ld. ASJ which came to be dismissed vide the impugned order. Considering that the impugned order is only with respect to interim maintenance, the present petition is disposed of with the directions that in case on receiving income affidavit, if any, the Trial Court reaches to a conclusion that the respondent is entitled for a lesser or a higher maintenance, the Trial Court would be at liberty to grant adjustment of the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
