% 04.10.2024 I.A. 41301/2024 (joint compromise application under Order XXIII Rule 3 read with Section 151 of the CPC) 1.
This is a joint compromise application under Order XXIII Rule 3 of the Code of Civil Procedure, 1908 (CPC) for recording of the settlement arrived at between the parties.

The application bears the signatures of the authorised representatives of the plaintiff as well as the defendant and their respective counsel. The application is also supported by affidavits of the authorised representatives of the plaintiff as well as the defendant.

The matter has been settled between the parties in terms of the Settlement Agreement dated 20th September, 2024 (hereinafter "Settlement Agreement"), which has been placed on record. 4.

representatives of the plaintiff and the defendant. 5.
I have gone through the terms of the settlement and do not find anything unlawful therein.

The parties shall remain bound by the terms of the Settlement Agreement.

Accordingly, the present application is allowed. CS(COMM) 393/2024 8.
The suit is decreed in terms of the aforesaid application and the Settlement Agreement, both of which will form part of the decree. 9.
The decree sheet be drawn up.

In view of the fact that the suit has been settled at an early stage, the Registry is directed to refund the entire Court Fees in favour of the plaintiff, in terms of Section 16 of the Court Fees Act, 1870. 11.
