In the status report filed on behalf of respondent no.1/MCD on 28th August, 2025, it was stated that a demolition order was passed in respect of construction on the subject property on 1st March, 2023. A sealing order was passed on 14th March, 2023, and the subject property was sealed on 14th May, 2025 and 2nd June, 2025.

It is also stated that an appeal has been filed by respondent no.2 against the sealing order before the Appellate Tribunal, MCD (ATMCD). The said appeal is stated to be pending. In the meanwhile, the respondent has also applied to MCD for regularization.

A fresh status report/ affidavit has been filed on behalf of the respondent no.1/ MCD on 23rd April, 2026.
3.1 The same is not on record.
3.2 A copy has been handed over in Court and the same is taken on record.

In the said status report, it is stated that a demolition action against the subject property was taken on 3rd February, 2026 and with the help of Police force from P.S. Model Town, two panels of roof slab were demolished. Photographs have been filed along with the said status report showing the demolition action. Further, a watch and ward letter dated 4th February, 2026 has been issued to SHO, P.S. Model Town. Further demolition action was also taken on 16th February, 2026, during which three (3) panels of R.C.C Slab at ground floor have been demolished and another watch and ward letter has been issued to the police authorities on 17th February, 2026. 5.
In view of the aforesaid action taken on behalf of respondent no.1/ MCD, the present writ petition is disposed of while directing MCD to take further action in accordance with law.

All rights, contentions and legal remedies of the parties are kept open. 7.
Pending applications also stand disposed of.
