BAIL APPLN. 304/2016 This is application under Section 438 of Cr.PC moved by the petitioner for grant of anticipatory bail in case FIR No. 561/2015 under Sections 452/308/506/34 IPC registered at Police Station Sonia Vihar, Delhi. A perusal of record goes to show that earlier an application for grant of anticipatory bail was moved by the petitioner before learned Additional Sessions Judge which was dismissed as withdrawn. As such, it will be desirable that the petitioner should approach learned Additional Sessions Judge for appropriate relief. At this stage, learned counsel for the petitioner, on instructions, seeks to withdraw the bail application with liberty to approach learned Additional Sessions Judge for appropriate relief.
In view of these submissions, the application is dismissed as withdrawn with liberty as prayed for.
