The petitioner has filed this petition under Section 29A of the Arbitration and Conciliation Act, 1996 ["the Act"] for extension of the mandate of the Arbitral Tribunal which is in seisin of disputes between the parties pursuant to an order dated 30.11.2016 in ARB.P. 516/2016. 2.

The arbitration proceedings have been going on for seven and a half years. This Court has granted several extensions of time, by orders dated 03.08.2018, 05.02.2020, 27.07.2022 and 18.07.2023. In the order dated 27.07.2022, parties were directed to make an endeavour to conclude the proceedings during the extended period of one year from 15.05.2022. This is the second petition for extension of time after the said O.M.P. Although Mr. Varun Rana, learned counsel for the respondents, appears on advance notice and does not object to the orders sought, the length of time taken in these proceedings is a cause for concern. 4.

Learned counsel for the parties state that the proceedings are at the fag end of the respondents' arguments. Mr. Rana states that two more sessions are required to conclude its arguments. Mr. Prashant Mehta, learned counsel for the petitioner, states that he will conclude his rejoinder submissions in one session.

The learned Arbitrator is requested to fix two sessions of two hours each for the respondents to conclude their arguments and one session of two hours for the petitioner to make its submissions in rejoinder. It is expected that the hearings will be concluded by 15.07.2024. The time for making of the award is extended until 15.09.2024. 6.

Learned counsel for the parties assure the Court that they will not seek any adjournment before the learned Arbitrator and will cooperate for the disposal of the proceedings within this time frame. The learned Arbitrator is requested to make all endeavours to ensure that further extension of time is not required.
