This petition has been filed by the petitioner under Section 9 of the Arbitration and Conciliation Act, 1996.

The learned counsel for the parties state that the parties have invoked the arbitration clause and nominated their respective Arbitrators. Both the counsel state that instead of an Arbitral Tribunal a Sole Arbitrator be appointed for adjudication of the disputes between the parties. They also state, pending decision by the Arbitral Tribunal, the interim order be continued.

Noting the submissions made by the counsel for the parties, I deem it appropriate to appoint Justice G.S. Singhvi, a Retired Judge of the Supreme Court as the Sole Arbitrator, who shall adjudicate the disputes between the
parties. The appointment of Justice Singhvi shall be regulated by the Rules of DIAC. Let a copy of this order be sent to Justice Singhvi. The parties shall appear before Justice Singhvi for preliminary hearing after taking prior appointment on his Mobile No. 9958677088.

It is made clear that the interim order dated July 9, 2019 shall continue during the pendency of the arbitral proceedings. 5.
Liberty is also with the parties to seek continuance / modification / variation of the order as well as raise all objections as available in law before the Learned Arbitrator.
The petition stands disposed of.
