Learned Counsel for the parties submit ad idem that, as an Arbitrator has been appointed to arbitrate on the dispute between the parties, this petition may be disposed of by directing it to be treated by the learned Arbitrator as an application under Section 17 of the Arbitration and Conciliation Act, 19961 and to take a decision thereon in accordance with law.

It is ordered accordingly. The learned Arbitrator is, therefore, directed to treat this petition as an application under Section 17 of the 1996 Act and decide in accordance with law.

The interim order already passed in this case shall continue to remain in operation subject to orders to be passed by the learned Arbitrator.
