O R D E R

The present petition raises a grievance as regards illegal and unauthorized construction raised at property bearing No.286, Basti, Hazrat Nizamuddin, New Delhi-110013.

Learned counsel for the MCD, who appears on advance notice submits, that part demolition action has already been taken qua the aforesaid unauthorized construction. He further submits that the MCD shall inspect the property and take further requisite action, as may be warranted, to remove the unauthorized construction, if any. 3.

Let the property in question be inspected by the MCD within one week, and further necessary action/steps be taken by the MCD expeditiously, and in any event, within a period of eight (08) weeks from today.

Needless to say, any action that may be taken by the MCD shall be subject to the statutory/ appellate remedies of the owner/occupier of the property.

in terms of the aforesaid directions.

In case there is any deficiency in the action taken by the MCD, the petitioner shall be entitled to avail appropriate remedies, in accordance with law.
