This petition has been filed seeking anticipatory bail granted to respondent no.2 by this Court on 13th November, 2019 in Bail Application no. 2437/2019.

Counsel for complainant/applicant in this matter, state that even though the charge sheet has been prepared and is under scrutiny, the original document of the sale, by the accused to M/s Radhika Homes Pvt. Ltd., has not been taken into custody and the Board Resolution on the basis of which the sale was made.

The charge sheet is being filed only on the basis of photocopies of the said documents.

APP for state states, on instructions, that they have moved for charges to be framed under Section 201 IPC in this regard. 5.
In this view of the matter, considering that the charge sheet has been filed, there will be no purpose serve for cancellation of anticipatory bail. 6.
Submission of APP is also noted that the accused did not join the investigation after the anticipatory bail was granted by this Court. 7.
However, the investigation did proceed on the material which were available and the charge sheet is being filed. 8.
Accordingly, petition is disposed of.
