This matter has been listed for hearing today on account of 05.02.2025 being declared as a holiday of the Court, pursuant to Office Order dated 31.01.2025 bearing No. 04/IG-4/Genl.-I/DHC. 2.
The present petition has been filed under Article 226 of the Constitution of India read with Section 482 of the Criminal Procedure Code, 1973 (Cr.P.C.) seeking the following reliefs:- "a. Quash the FIR No.0482/2022, dated 16.10.2022 registered under section 498-A/324/312 of Indian Penal Code, at P.S. Kishan Garh, New Delhi, against the petitioners;
b. Quash the proceedings emanating from the FIR No.0482/2022, dated 16.10.2022 registered under section 498-A/324/312 of Indian Penal Code, at P.S. Kishan Garh, New Delhi, if any." 3.
It is stated in the petition that a separate FIR No. 0528/2021 dated 29.12.2021 under Sections 498A/34 of the Indian Penal Code, 1860 (IPC) W.P.(CRL) 1530/2024 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. already stands registered at Police Station Sagarpur at the instance of the complainant i.e., Respondent No. 2. It is stated that the proceedings arising out of the said FIR is at the stage of prosecution evidence and is proceeding further.

It is stated that in these circumstances, the registration of the subject FIR No. 0482/2022 dated 16.10.2022 under Sections 498A/324/312 of the IPC at Police Station Kishan Garh for the same allegations is impermissible. 5.
The learned Standing Counsel states that status report has been filed on 26.05.2024. He states that the final cancellation report with respect to FIR No. 0482/2022 stands prepared in this matter on the basis of the assertion made in this petition and the said report will be filed before the concerned Court within a period of one (1) week. 6.
None appears on behalf of the Petitioner.

In view of the status report and the statement made by the learned Standing Counsel, the prayer sought in the petition stands satisfied. Accordingly, the petition is hereby disposed of along with pending application.
