% 10.08.2018 The present petition has been filed by the petitioners with the following prayers:
"It is, therefore, most respectfully prayed that the Hon‟ble Court may graciously be pleased to issue:- (i) A Writ of Certiorari or any other writ, order or direction quashing and setting aside the order dated 11.01.2013 passed by respondent No.2 declining the petitioners‟ request to renew their bus permits;
(ii) A Writ of mandamus or any other appropriate writ, direction or order directing the respondents to renew the permits of the petitioners grnated to them under „Ex-servicemen Scheme‟ to ply their Stage Carriage Buses in Delhi;
(iii) An appropriate writ, direction or order directing
the respondent to restore and renew the permanent permits of the petitioners for a period of five years granted to them under „Ex-servicemen Scheme‟ to ply their Stage Carriage Buses in Delhi;
(iv) Any other relief, order or directions which this Hon‟ble Court considers just and fit in the circumstances of the case."
It is an admitted position that the petitioners were granted the benefit of plying the buses under Stage Carriage Permits being Ex-servicemen. It is conceded by Mr. Avadh Kaushik, learned counsel for the petitioners that the permits of the petitioners have not been renewed post 2011. It is not the case of the petitioners that permits granted to other Ex-servicemen have been renewed after 2011.
It is the case of the respondents that no Scheme meant for Exservicemen is in place. Noting the submissions made, in the facts of this case the only direction that can be given while disposing of the writ petition is that the petitioners shall be at liberty to make representations to the respondents for considering their case for plying the buses in any of the schemes in vogue with the respondents and for which the petitioners are eligible. If such representations are made by the petitioners, the respondents shall dispose of the same within six weeks from the date of receipt of the representations.
The writ petition is disposed of.
