1. In view of the order passed by this Court on 6th February, 2019 in the Revenue's appeal in ITA No. 129/2019, involving the same Assessee, the present appeal which is for the Assessment Year 2009-10 is dismissed.

2. However, as clarified in the above order, the parties will be bound by the decision of the Supreme Court on the question of law in the appeal arising from the decision in Director of Income Tax International Taxation v. G. E. Packaged Power Inc., (2018) 373 ITR 65.
