% 08.01.2024 I.A. 339/2024 (for withdrawal of suit) & CS(OS) 435/2022 Present application bearing I.A. 339/2024 has been moved seeking withdrawal of the present suit along with the pending applications on account of amicable settlement arrived at between the parties. Learned counsel for defendant no.2 also states that the parties have reached on a settlement.

Perusal of the record indicates that the right of defendant no.1 to file the written statement has already been closed vide order dated 23.05.2023. In view of the amicable settlement arrived at between the parties, the suit bearing CS(OS) No.435/2022 along with the pending applications is dismissed as withdrawn as compromised.
