This petition is filed seeking anticipatory bail in FIR No.36/2023 under Sections 419/420/120B IPC and Section 66D of IT Act, registered at Police Station Cyber Police Station, New Delhi.

Interim protection was granted to petitioner by this Court by order dated 16th May 2024. Status report has been filed. 3.

The complaint was registered alleging that there was a Facebook friend request received by wife of complainant which she accepted and started chatting on Facebook messenger. During such chats, the user requested for urgent need of money and complainant transferred money to the said account. The case was of cheating of Rs.75,000/- and further Rs.1 lakh. 4.

APP for the State, on instructions from the IO, submits that Notice under Section 41A Cr.P.C. has been served upon petitioner and he has joined investigation and that arrest of accused is not required. that investigation is to proceed with respect to co-accused Gulshan Kumar. 5.

In light of the above, the Court is of the considered opinion that the petitioner is entitled to anticipatory bail. Consequently, in the event of arrest the petitioner be released on bail on furnishing a personal bond in the sum of Rs. 25, 000/- with one surety of the like amount subject to the satisfaction of the arresting officer/IO/SHO concerned, further subject to the condition that the petitioner will join investigation as and when directed and not influence any witness/complainant/victim or tamper with evidence of the case. 6.

Accordingly, the petition is disposed of along with pending applications, if any.
