The present petition under Article 227 of the Constitution of India has been filed to impugn the order dated 16.02.2024 passed by the learned National Consumer Disputes Redressal Commission, New Delhi (hereinafter referred to as „NCDRC‟), in I.A.No.2146/2024 in Revision Petition No. 1254/2022 titled as "M/s Shalini Housing Promoters & Builders vs. Mohan Lal & Anr.", whereby the learned NCDRC allowed the stay application of the petitioner and stayed the operation of the order learned State Consumer Disputes Redressal Commission (hereinafter referred to as "SCDRC") and District Consumer Disputes Redressal Forum, subject to the petitioner depositing the entire decretal amount within four weeks. The Learned counsel for the petitioner submits that at the time of grant of stay the learned NCDRC has imposed a condition for deposit of 100% of the decretal amount.

Learned counsel for petitioner seeks permission to withdraw the present petition with liberty to move an appropriate application as per law before the learned NCDRC within one week, from today to consider the submission for not been able to deposit of the 100% decretal amount as well for enlargement of time period within which it is to be deposited as has been pleaded before this Court.

Permission granted to withdraw with liberty as prayed for. 5.
Accordingly, the present petition along with the pending applications stands disposed of.
