O R D E R

% 13.02.2020 1.Mr Bhardwaj, learned CGSC appearing for Union of India, produces a copy of written communication dated 31st January, 2020, received by him from the department, stating that the 2nd and 3rd financial upgradation under the MACP scheme were granted to the Petitioner on completion of 20 and 30 years of service respectively on 1st September, 2008. However, the Petitioner‟s pay fixation could not be done for higher pay "due to oversight". It is stated that process of fixing his pay in the higher scale is under process and the same will be completely shortly.

2. The Respondents are directed to correctly fix the pay of the Petitioner and pay him the arrears by issuing appropriate orders within 12 weeks from today. Since the Petitioner has superannuated in the meanwhile, his pension payment orders should also be issued, keeping in view the above directions. If pension payment orders have already been issued, the same should be

revised, consistent with these directions. If the time-bound directions are not complied with, the Respondents will pay simple interest at 6% per annum on the sum due for the period of delay.

3. The petition is disposed of in the above terms. No costs. S.MURALIDHAR, J.
