By way of the present petition, the petitioners seek quashing of the FIR bearing No. 042/2022 dated 06.01.2022, registered at Police Station Malviya Nagar, Delhi, for the commission of offences punishable under Sections 498A/406/506/377/34 of the Indian Penal Code, 1860 (hereafter 'IPC').

Issue notice. Mr. Rajkumar, the learned APP accepts notice on behalf of the State.

All the petitioners are present before this Court and have been identified by their counsels and Investigating Officer (IO) concerned, Police Station Malviya Nagar, Delhi.

Brief facts of the case are that petitioner no. 1 is the husband of respondent no. 2. It is stated that on 06.01.2022, an incident took place between the parties, whereupon respondent no. 2 had made a complaint against the petitioners at Police Station Malviya Nagar, Delhi which culminated into the present FIR. It is also stated that with the intervention of family members, relatives and well wishers, the parties have now amicably settled their disputes vide Settlement Agreement dated 18.04.2023 and have obtained decree of divorce by way of mutual consent from the concerned Court.

On a query made by this Court, respondent no. 2 who has been identified by the IO concerned, has categorically stated that she has entered into compromise out of her own free will and without any pressure, coercion or threat. Therefore, she has no objection if the present FIR is quashed. The statement of the parties to the said effect had been recorded by the learned Joint Registrar (Judicial) on 09.05.2025.

In view of the above, and that the parties have amicably resolved their differences of their own free will, and without any coercion, and no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 9.
