This petition is preferred on behalf of the Petitioner under Section 29A (4) and (5) of the Arbitration and Conciliation Act, 1996 ('1996 Act') seeking extension of the mandate of the learned Arbitrator. 2.

Present arbitration proceedings emanate out of Letter of Award dated 03.08.2015 pursuant to invitation of bids for 'supply, installation and commissioning and maintenance of Light Controls CCMS boxes for installed LED street lights at Agartala Municipal Corporation'. Petitioner filed a writ petition in this Court being W.P.(C) No. 12282/2019 challenging order dated 30.08.2019 of the Adjudicator appointed by Respondents No. 1 and 2 and this Court vide order dated 10.12.2019 referred the disputes to Delhi International Arbitration Centre ('DIAC') to appoint a Sole Arbitrator. DIAC appointed a former Judge of the Supreme Court and the first hearing was fixed for 23.05.2023.

Since one year period from date of completion of pleadings was expiring on 09.07.2024, on 04.05.2024, the learned Arbitrator extended the period by six months, with the consent of the parties and posted the matter for hearing on 07.08.2024 and 08.08.2024. It is stated in the petition that presently the arbitral proceedings are at the stage of final arguments and the mandate of the learned Arbitrator has expired on 08.01.2025. 4.

Issue notice.

Mr. Samdarshi Sanjay, learned counsel for the Respondents accepts notice and on instructions, submits that the Respondents have no objection to the extension of mandate of the learned Arbitrator. 6.

Accordingly, with the consent of the parties and considering that the arbitral proceedings are at the stage of final arguments, mandate of the learned Arbitrator is extended by a period of 04 months from 09.05.2025 and period between 09.01.2025 to 08.05.2025 is regularised. 7.

Petition is allowed and disposed of in the aforesaid terms.
