The present petition has been filed by the petitioner seeking direction for the respondent no. 1/ Divisional Commissioner to expedite the disposal of the Appeal No. 686/2023 filed by the petitioner, under Rule 22(3)(4) of the Delhi Maintenance and Welfare of Parents and Senior Citizen Rules, 2009 (hereinafter 'the Rules'), against the order dated 05.01.2023 passed by the District Magistrate, South West District. 4.

Vide order dated 05.01.2023 the District Magistrate, South West District, dismissed the complaint dated 18.08.2021 filed by the petitioner under Rule 22(3) of the Rules, for eviction of respondent no. 2 and 3 from the property bearing house no. 346, Main Market, Kapashera Village, South West Delhi-110037.

It is submitted that the Appeal No. 686/2023 has not been decided by the concerned Appellate Authority even though the appeal was filed as far back on 09.02.2023.

Given the limited nature of the relief sought, the present petition is disposed of with the direction to the respondent no. 1 to expeditiously decide the aforesaid appeal filed by the petitioner. 7.

Let an endeavour be made to decide the same within a period of 12 weeks from today.

Learned counsel for the respondent no. 1, who appears on advance notice, assures and undertakes that an endeavour shall be made to expedite the matter and hearing/s shall be scheduled at short interval so as to ensure that the matter is disposed of within the aforesaid period. 9.
