By way of the present petition, the petitioner seeks to assail the order dated 05.09.2023 passed by the learned ASJ, Rohini Courts, New Delhi in Criminal Appeal NO.63/2023 titled 'Ashish Wadhwa v. Shivani Wadhwa'. 2.

At the outset, learned counsel for the petitioner, upon instructions, states that the challenge in the instant petition is restricted only to the observations made in the impugned order whereby the learned Sessions Court has remanded back the matter to the Court of learned Judicial Magistrate First Class to consider the issue of interim maintenance afresh. 3.

Needless to state that the observations made by the learned Sessions Court were only for the purpose of disposal of the said appeal and the learned Judicial Magistrate First Class shall apply its independent mind while considering the application of interim maintenance afresh in accordance with the law.

The petition is disposed of in above terms.
