Both these petitions arise out of order of the Metropolitan Magistrate, Mahila Court, South District, Saket Courts, dated 21.02.2019, by which the Court fixed interim maintenance of Rs.50,000/- per month payable by the husband [petitioner in CRL.M.C. 935/2023] to the wife [petitioner in CRL.M.C. 2833/2023]. Both the parties assailed the aforesaid order before the Additional Judge, South District, Saket Courts, ["Sessions Court"] in Criminal Appeal Nos. 142/2019 and 174/2019. The Sessions Court, by a common judgment dated 06.01.2023, affirmed the order of the Mahila Court. This has brought both parties to this Court. 2.

In the course of these proceedings, the proceedings for execution of the order of the Mahila Court have been stayed by orders dated 10.02.2023, 13.05.2024, and 02.12.2024. These orders were modified by the order dated 20.08.2025, by which the Court directed that no coercive steps would be taken against the husband in the pending execution proceedings, or in the applications which have been preferred by the wife. I am informed that, during the pendency of these proceedings before this Court, pursuant to conditions imposed while granting stay, the husband has made payment of ad hoc amounts to the total of Rs. 50,00,000/- to the wife.

After some hearing, learned counsel for both sides submit that these petitions may be disposed of with the following directions: a. Interim maintenance of Rs. 50,000/- per month fixed by the Mahila Court vide order dated 21.02.2019, as affirmed by the Sessions Court vide judgment dated 06.01.2023, will continue to operate, for the present.

b. All arrears of payment will be made by the husband to the wife within a period of six weeks from today, after adjustment of the aforesaid amount of Rs. 50,00,000/-. Learned counsel on both sides accept that the amount of Rs. 25,00,000/- remains due to the wife, in terms of the said orders.

c. The parties are free to approach the Mahila Court for modification of the amount of interim maintenance, which will be decided by the Mahila Court in accordance with law.

d. Needless to say, these arrangements are not intended to constitute any expression of opinion, either with regard to the interim maintenance or the final orders to be passed by the Mahila Court under the Protection of Women from Domestic Violence Act, 2005, or to affect the merits of any other litigation between the parties.
