Learned counsel for respondent No.1 states that respondent No.1 shall purchase the second floor of the Shiv Nagar property mentioned at serial No.2 at page 543 of the paper book by way of a registered sale deed tomorrow. He undertakes to this Court that there shall be a covenant in the sale deed that the appellant shall have a lifetime interest of residence in the said property without any hindrance and no third party interest in the said property shall be created to her detriment and she shall not be prejudiced without her consent. He also states that the possession of the Shiv Nagar property shall be handed over to the appellant and her two children tomorrow. He, however, prays that the appellant and her daughter should vacate the property bearing No.AD-68, Tagore Garden, New Delhi-110027 on or before 07th March, 2024.

Appellant, who is physically present in Court, is agreeable to the same. She assures and undertakes to this Court that she shall withdraw the complaint filed by her under the Domestic Violence Act against respondent No.1 and Mr. Sameer Kohli, presently pending before Ms. Akansha Gautam, Metropolitan Magistrate being MC No.5551934/2016. 3.

The undertakings and assurances given by both the parties are accepted by this Court and the parties are held bound by the same. Accordingly, the present application and appeal stands disposed of and the next date of hearing is cancelled.
