The petitioners are all employees of respondent No.2 - Jawaharlal Nehru University ["JNU"]. They seek pensionary benefits under the Old Pension Scheme ["OPS"] applicable to employees who joined service prior to 01.01.2004.

Dr Ashwani Bhardwaj, learned counsel for the petitioners, relies upon a judgment of a coordinate Bench in Chandi Prasad and Ors. v. Union of India and Ors. which was also in respect of employees of JNU. 3.
Mr. Vasanth Rajasekaran, learned Senior Standing Counsel for JNU who appears on advance notice, candidly submits that the position of the present petitioners is identical to the petitioners in Chandi Prasad (Supra). He further submits that although the judgment in Chandi Prasad (Supra) has been challenged in LPA 98/2025, the Division Bench has not passed any interim order.

In view of the fact that the case of the present petitioners is covered by the judgment in Chandi Prasad (supra), this writ petition is also allowed, and it is held that the petitioners will be covered by the OPS. JNU is directed to issue necessary orders within three months from today. 5.
The petition is disposed of.
