Counsel for the plaintiff and the defendant no.1 submit that the parties have settled their dispute in mediation proceedings before the Delhi High Court Mediation and Conciliation Centre ('Mediation Centre'). 2.

The Settlement Agreement dated 20th March, 2025, (hereinafter 'Settlement Agreement') which bears the signatures of the authorised representative of the plaintiff and the defendant no.1, has been placed on record.

I have perused the terms of the Settlement Agreement and do not find anything unlawful therein.

The parties shall remain bound by the terms of the Settlement Agreement.

In terms of the Settlement Agreement, the suit is decreed against defendant no.1. The Settlement Agreement shall form part of the decree. 6.

Defendant no.2 was proceed against ex-parte vide order dated 23rd October, 2024.

Mr. Urfee Roomi, counsel appearing on behalf of the plaintiff submits that the defendant no.2 was a distributor of the goods being manufactured by defendant no.1.

In view of the decree being passed against defendant no.1, a decree of permanent injunction is also passed against defendant no.2 in terms of prayer clauses 61 (a), (b), (c) and (d) of the plaint. 9.

Let the decree sheet be drawn up accordingly. 10.

Since the matter has been settled in mediation proceedings, the Registry is directed to issue a certificate of refund of 100% of the Court Fees in favour of the plaintiff through their counsel, in terms of Section 16 of the Court Fees Act, 1870, read with Section 89 of the Code of Civil Procedure, 1908. 11.

All pending applications stand disposed of.
